1. Acceptance of Terms

By accessing or using RankSimply ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We reserve the right to update these terms at any time, and continued use constitutes acceptance of any changes.

2. Description of Service

RankSimply is an AI-powered SEO content platform that provides automated keyword research, article generation, image creation, content verification, and publishing to connected websites. The Service integrates with third-party APIs including DataForSEO, Anthropic Claude, OpenAI, and Ghost CMS.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Subscription Plans & Billing

RankSimply offers multiple subscription tiers (Scout, Settler, Sovereign, and Done For You). All self-serve plans include a 7-day free trial with no credit card required. After the trial period, your selected plan will be billed monthly.

• You may cancel your subscription at any time; access continues until the end of the billing period.
• Refunds are not provided for partial billing periods.
• The Done For You (Agency) tier includes a one-time $499 onboarding fee that is non-refundable.
• Third-party API costs (e.g., DataForSEO) are billed separately and are not included in your subscription.

5. Acceptable Use

You agree not to:

• Use the Service to generate content that is illegal, defamatory, or infringes on intellectual property rights.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Exceed the usage limits of your subscription plan through automation or other means.
• Resell or redistribute generated content as a competing service without a Done For You plan.
• Use the Service to generate spam or manipulative content intended to deceive search engines.

6. Content Ownership

You retain ownership of all content generated through the Service using your account. RankSimply does not claim any intellectual property rights over your generated articles, images, or other outputs. However, you grant RankSimply a limited license to process your content as necessary to provide the Service.

7. Third-Party Services

The Service relies on third-party APIs and platforms (DataForSEO, Anthropic, OpenAI, Ghost CMS). RankSimply is not responsible for the availability, accuracy, or policies of these third-party services. Your use of these integrations is also subject to their respective terms of service.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. RankSimply does not guarantee that generated content will achieve specific search rankings, AI citation rates, or traffic results. SEO and GEO outcomes depend on many factors outside our control.

9. Limitation of Liability

To the maximum extent permitted by law, RankSimply shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may export your content before your account is closed.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law provisions.
